DPA (data processing agreement)
Definition
A data processing agreement (DPA) under Art. 28 GDPR governs how a provider processes personal data on a company's behalf: purpose, instructions, technical and organizational measures, sub-processors, deletion duties. Without a DPA, using a data-processing SaaS service in the EU is generally not GDPR-compliant.
For agent control layers the DPA matters especially because tool-call arguments can contain personal data - names, order numbers, account details. What counts: EU hosting, encryption at rest, clear deletion rules and a DPA available without negotiation.
